Terms and Conditions of Use
The BeerMapper application (the "App") is software owned by savvo digital sommelier solutions, LLC (“savvo”).
You agree that your use of the App is subject to the following Terms and Conditions. These Terms and Conditions may be modified at any time and from time to time; the date of the most recent changes or revisions is November 5, 2014. Continued access to the App by you will constitute your acceptance of any changes or revisions to the Agreement. If you do not agree with the Terms and Conditions, please do not use the App.
The materials contained on the App are provided by savvo as a service to you for your use on an "as is, as available" basis. You acknowledge that you are using the App at your own risk. savvo assumes no responsibility for error or omissions in these materials. savvo makes no commitment to update the information contained herein. savvo makes no, and expressly disclaims any and all, representations or warranties, express or implied, regarding the App, including without limitation the accuracy, completeness, timeliness, or reliability of text, graphics, links, content, products and services, recommendations and other items accessed from or via the App, or that the App will be uninterrupted, error-free, or free of viruses or other harmful components. No advice or information given by savvo or any other party on the App shall create any warranty or liability. The App and the materials provided herein are for informational purposes only and are not legal advice. No reader should rely on or act or refrain from acting on the basis of any matter or information contained in the App without seeking appropriate legal or other professional advice.
Under no circumstances shall savvo or any of its parents, subsidiaries, affiliates, members, advisors or their respective partners, officers, directors, employees, or agents be held liable for any damages, whether direct, incidental, indirect, special, or consequential, and including, without limitation, lost data, revenues, or profits, loss of or damage to property and claims of third parties, arising from or in connection with your use or performance of the App or your reliance on the information on the App.
savvo periodically schedules system downtime for maintenance and other purposes. Unplanned outages also may occur. savvo shall have no liability for the resulting unavailability of the App or for any loss of data or transactions caused by planned or unplanned system outages, or any outages of webhost providers or the Internet infrastructure and network external to the App.
All materials published on the App, including the compilation (meaning the collection, arrangement and assembly) of all content on the App, are protected by U.S. and international copyright laws. You may not reproduce, republish, distribute, transmit, resell, display, broadcast, or otherwise exploit such material in any manner without the express written permission of either savvo and, in the case of content licensed by savvo from third parties, the entity that is credited as the copyright holder of such licensed content. Scraping of the app or website, or otherwise automatically extracting any copyrighted information from such, is forbidden.
Beer image credit and copyright belong to the photographers who took them - the users and staff of ratebeer.com.
BeerMapper, savvo digital sommelier solutions, LLC., and all page headers, maps, layers, customized lists, custom graphics and button icons are service marks, trademarks, and/or trade dress of savvo and may not be used in connection with any product or service that is not offered by savvo. All other trademarks and company names or logos cited herein are the property of their respective owners.
The App may provide information from or about featured service, content, or product providers (collectively “providers). The companies that savvo selects as featured providers offer services, content, or products that App visitors may find useful. savvo in certain cases may have a business relationship with certain third parties that it selects as featured providers. savvo is not responsible for the accuracy or reliability of any advice or information given, or of any statement made, by or regarding such featured service providers, or for the content, services, products, or advertising on or available from their websites, or for the availability and operations of their websites.
The App contains content that should only be accessed by people of the legal drinking age in their locale.
Health and Safety Liability
savvo encourages all those who use our Apps and websites to have a safe and healthy relationship with beer, wine and all other alcoholic beverages. We encourage moderation with attention to quality rather than quantity. We also encourage a responsible approach to transportation and other activities that may be hazardous after drinking alcoholic beverages and support a designated driver program. The BeerMapper user agrees not to hold savvo liable for any negative effects of beer and/or alcohol on their health or safety.
You agree that any claim, action, or proceeding arising out of these Terms and Conditions, or your use of the App, shall be governed by and construed in accordance with the laws of the State of Illinois applicable to contracts to be wholly performed therein, and any action based on or alleging a breach of this Agreement must be brought in a state or federal court in Illinois. In addition, you agree to submit to the personal jurisdiction of such courts.
What personal information is collected from me?
Occasionally, users of the App may be asked to supply certain personal information, such as the user’s name, postal address, e-mail address, friends list, telephone number, other publically available information or credit card information, which is then retained by savvo.
How does savvo use the personal information supplied by me?
If you choose to give us personal information, such information will be retained by us and used to provide you with the information or services you have requested, or to provide you with additional information from savvo about savvo or the App, its affiliates, or selected outside companies whose products or services we feel may be of use to you. Any information we provide to you about outside companies or other third parties will be transmitted by savvo so that such third parties will not have access to your e-mail address or to your other personal information. savvo does not currently sell or license your personal information to any other company or organization.
From time to time, the personal information that you provide to us may be shared with companies that perform services for us, such as providers who assist us in maintaining and managing our websites, databases, software, newsletters, and/or processing credit card payments. Such companies may use your personal information only in the course of providing services to savvo, and they may not use or disclose your personal information for other purposes.
savvo may use your personal information to create aggregated, anonymous data about our users in order to develop statistics about activity on and visitors to the App. We may share this aggregate information with our members and with other companies. This information does not identify individual users or companies.
In addition, savvo may disclose your personal information if we in good faith believe that such action is necessary to (1) comply with the law or with legal process; (2) protect and defend our rights and property; (3) protect against misuse or unauthorized use of the App; or (4) protect the personal safety, property, or rights of our users or the public.
What if I no longer wish to receive information from Savvo?
If, at some point after giving savvo your personal information, you do not wish to continue to receive additional information from savvo, you may opt out by e-mailing and put the words "remove my name" in the subject line of your e-mail.
How is my personal information protected?
savvo maintains physical, electronic and procedural safeguards to protect your personal information. For example, we use industry-standard password protection for our databases. All user passwords are encrypted using a 3DES (Triple Data Encryption Standard) algorithm. Passwords are never stored in un-encrypted form.
Unfortunately, despite all of our efforts, there is always a risk that third parties may unlawfully intercept transmissions. As a result, we cannot ensure the security of any information you transmit, and you transmit all information at your own risk.
In the event that you should have an issue with your order, please email email@example.com within 30 days. We will work with you on a resolution to the issue, which may include replacement, credit or full refund.
